What are the conditions under which you can appeal?

When applying for an appeal, it is essential to ensure compliance with the Family Procedure Rules, specifically Part 30 of the Family Court Rules. The appropriate form must also be used when submitting your application.

To succeed in an appeal, you must demonstrate that the judgment made by the lower court is either wrong or unjust. This requires proving that procedural errors occurred in the court's order. Only by establishing such errors can your appeal be successful.

For example, if you believe the judge's decision is incorrect, you may proceed with your appeal. However, if the appeal court determines that the lower court's decision was correct, your appeal will be unsuccessful.

To achieve a successful appeal, you must show that a mistake or incorrect application of the law occurred. Your appeal is more likely to be accepted if you present a compelling reason.

Upon submission, the appeal court will review the lower court's decision. It will not conduct a new trial but will evaluate the information presented to the lower court at the time of the original judgment.
